Nursing Home Abuse & Negligence

According to the U.S. Census Bureau, 1.6 million older Americans, or 4% of the overall population of those 65 and older, live in nursing home facilities. Many of them are frail and dependent on professional helpers hired to meet their most basic needs. Unfortunately, some of the most vulnerable residents end up being abused or neglected in their nursing home facilities.

Without proper care, bedridden nursing home residents in particular may suffer from bed sores, infections, or injuries caused by a fall. Injured senior citizens require even more care, at greater expense, and become even more dependent on others for help.

Nursing home facilities in all states must, at minimum, comply with the mandates of federal regulations, including:

  • That the nursing homes have sufficient staff to meet the residents' needs
  • That the nursing homes develop an individualized care plan for each resident
  • That the nursing homes provide the services necessary to maintain good nutrition and hygiene for each resident
  • That the nursing homes recognize each resident's right to choose activities, health care, etc.

In addition, some states have enacted laws that go beyond the federal requirements, affording their citizens even greater protection against nursing home abuse and neglect.
